Resumo

Este trabalho apresenta alguns dispositivos jurídicos referentes à saúde e segurança do trabalho que são aplicados no serviço público federal. Tem por objetivo verificar se a legislação existente proporciona o embasamento teórico necessário para a efetiva proteção dos servidores. Sendo o trabalho um direito constitucional, imprescindível que todos os trabalhadores disponham de um ambiente que preserve sua saúde e integridade física e moral. Através da análise, verificou-se que as normas relativas à segurança do trabalho aplicáveis a Administração Pública limitam-se a estabelecer diretrizes, distribuir competências e implantar premissas básicas, não oferecendo meios para uma concretização eficaz, precisando, dessa maneira, da utilização das regras da área privada.

This paper presents some legal provisions relating to helth and safety at work that are applied in the federal public service. Has per objective verify if the existing legislation provides the theoretician basis required for the effective protection servers. Being the work a right constitutional, indispensable what all the workers have an environment that preserves their health and physical and moral integrity. Through the analysis, it was verified that the rules relative the work security applicable to Public Administration limit themselves to establishing guidelines, distribute professional skills and implement assumptions basic, not offering the means to an effective concretization, needing, thus, of the use of rules of private área.
